Contract Claims under the Contract Disputes Act (”CDA”)
- The Contract Disputes Act of 1978, as amended (41 U.S.C. 601-613) applies to nearly all contracts awarded by the U.S. Government. The CDA establishes procedures and requirements for asserting and resolving contract claims. The full text of the CDA may be found at http://www4.law.cornell.edu/uscode/html/uscode41/usc_sup_01_41_10_9.html.
- Generally, CDA claims must be first filed with the contracting officer. Claims over $100,000 must be certified by the contractor.
- A claim that is denied may be appealed to the appropriate board of contract appeals or to the Court of Federal Claims.
